TERMS AND CONDITIONS

Blessings from Ora Wellness Co. (hereinafter referred to as “the Studio”). By accessing, enrolling in, or participating in any of our Yoga, Pilates, Breathwork or Meditation classes, workshops, events, or using our facilities, you agree to comply with the following terms and conditions. Please read them carefully before engaging in any services offered by the Studio.

1. Acceptance of Terms

By registering for classes, workshops, or any other services offered by the Studio, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

2. Membership and Fees

2.1 Membership Options

The Studio offers various membership packages, class passes, and drop-in options. Details of these options, including pricing, are available at the Studio or on our website.

Memberships are personal and non-transferable unless specified otherwise in writing by the Studio.

Memberships and class pass benefits may be changed with notice to current holders of such passes and memberships.

2.2 Payments

All payments must be made in advance, and payment methods accepted include, credit card and online transfers.

Membership fees are non-refundable, except as required by applicable law or as otherwise stated in these terms.

In cases of refund, a partial refund is only possible.

2.3 Cancellation Policy

Classes: Reservations must be cancelled at least 2 hours before the scheduled class to avoid forfeiting the session.

Memberships: Weekly memberships may be cancelled after 30 days of entering into your contract. Cancellation of membership may be requested online in your member account or in writing.

3. Health and Safety

3.1 Medical Disclaimer

By participating in classes or using Studio facilities, you confirm that you are in good physical condition and do not suffer from any medical condition that could be aggravated by physical activity. If you have any injuries, it is your responsibility to inform the instructor of the class.

If you have any injuries, medical conditions, or are pregnant, you must consult your physician before participating and inform the instructor prior to class.

3.2 Assumption of Risk

You acknowledge that participation in Yoga, Pilates, Meditation, Breathwork or any fitness activities involves inherent risks, including the risk of injury. The Studio is not responsible for injuries sustained while participating in activities or using the facilities.

3.3 Code of Conduct

Participants are expected to follow instructions from instructors and staff at all times.

Disruptive or inappropriate behavior, including harassment or violation of Studio policies, may result in suspension or termination of membership without refund.

4. Liability Waiver

The Studio, its owners, instructors, employees, and affiliates are not liable for any personal injury, property damage, or loss sustained by participants while on Studio premises or during Studio activities.

By participating, you release the Studio from any claims or liabilities to the fullest extent permitted by law.

5. Scheduling and Changes

The Studio reserves the right to modify class schedules, substitute instructors, or cancel classes at its sole discretion. Participants will be notified of significant changes.

The Studio may close temporarily for maintenance, holidays, or emergencies. Memberships and class passes will be extended for any and all closures.

6. Personal Belongings

The Studio is not responsible for the security of personal belongings. Please store items in designated areas and avoid bringing valuables.

7. Privacy Policy

Personal information collected during registration or participation in Studio activities will be handled in accordance with our Privacy Policy. The Studio will not share your information with third parties without your consent.

8. Termination of Membership

The Studio reserves the right to terminate your membership or participation in activities for violations of these terms and conditions, non-payment of fees, or other misconduct.

Refunds, if applicable, will be processed in accordance with our refund policy.

9. Governing Law

These terms and conditions are governed by the laws of Western Australia. Any disputes shall be resolved in accordance with the applicable laws of this jurisdiction.

10. Amendments

The Studio reserves the right to update or amend these terms and conditions at any time. Changes will be effective immediately upon posting on our website or other communication channels.

By participating in activities or using services provided by the Studio, you agree to these Terms and Conditions.

Class cancellation policy

CANCELLATION TERMS AND CONDITIONS

These Cancellation Terms and Conditions outline the policies regarding the cancellation of memberships, classes, workshops, events, and other services provided by Ora Wellness Co. (hereinafter referred to as “the Studio”). By registering for any service or event, you agree to adhere to these terms.

1. Class Cancellation Policy

1.1 Individual Class Cancellations by Participants

Notice Period: Participants must cancel their reservation at least 2 hours before the scheduled class time.

Late Cancellation or No-Show:

If you cancel within the notice period, no penalty will be incurred, and the session credit will be retained.

If you cancel after the notice period or fail to attend, the session credit will be forfeited.

1.2 Class Cancellations by the Studio

The Studio reserves the right to cancel a class due to unforeseen circumstances, such as instructor unavailability or insufficient attendance. Participants will be notified as soon as possible.

In the event of a Studio-initiated cancellation, participants may choose to reschedule the session or receive a session credit/refund as applicable.

2. Membership Cancellation Policy

2.1 Monthly Memberships

Monthly memberships may be cancelled at your request within your member portal after 30 days of initial contract agreement or in writing to our team.

Cancellations requested after the billing date will apply to the subsequent billing cycle, and no prorated refunds will be provided for partial months.

2.2 Suspensions/Pauses

Members may request a temporary suspension of their membership for a valid reason (e.g., illness, travel) with prior notice. Members may pause their membership up to two times in a calendar year.

3. Refund Policy

Refunds, where applicable, will be processed within 1-5 business days after the cancellation request is approved.

Refunds will be issued via the original payment method unless otherwise agreed.

Non-refundable fees include administrative charges, late cancellation fees, and other charges explicitly stated at the time of purchase.

4. Special Offers and Promotions

Services purchased under special offers, promotions, or discounts are non-refundable unless otherwise stated.

5. Health-Related Cancellations

Participants unable to attend due to medical reasons may request a refund or reschedule with appropriate documentation. Requests must be submitted promptly and are subject to Studio approval.

6. Communication of Cancellations

All cancellations must be completed or communicated via GymMaster App, email: info@orawellness.com.au or via call or text to: 0472 594 083. If prior to two (2) hours of class commencement please cancel via online booking system to not lose your pass. Within two (2) hours of class commencement, student will not receive a refund or credit for the class unless under extraordinary circumstances discussed with management.

The timestamp of the cancellation request will determine whether it falls within the allowable notice period.

7. No Exceptions Policy

The Studio adheres strictly to these cancellation terms to ensure fairness to all participants and staff. Exceptions will only be made under extraordinary circumstances and at the sole discretion of the Studio.

8. Amendments

The Studio reserves the right to amend these cancellation terms at any time. Updates will be communicated through the Studio’s website or other official channels.

By enrolling in classes, workshops, memberships, or events, you agree to abide by these Cancellation Terms and Conditions.

Event/workshop Placeholder T&C’s

Reservation Confirmation: A confirmed event placeholder guarantees your spot for the specified wellness event. Confirmation is only valid upon receipt of payment (if applicable).

Cancellation Policy:

Cancellations made more than 48 hours before the event will receive a full refund or credit towards a future event.

Cancellations within 24 hours of the event are non-refundable but may be eligible for credit under special circumstances at the discretion of the organizer.

No-Show Policy: Failure to attend the event without prior cancellation notice will result in forfeiture of the placeholder fee and any associated benefits.

Transferability: Placeholders are transferable. Contact the Ora Wellness team to arrange.

Event Changes: The organizer reserves the right to reschedule, modify, or cancel events. In such cases, participants will be notified promptly, and a refund or rescheduling option will be provided.

Arrival Time: Participants must arrive on time for events. Late arrivals may not be accommodated, and fees will not be refunded.

Behaviour and Etiquette: All participants are expected to maintain respectful behaviour. The organizer reserves the right to deny entry or remove any participant who disrupts the event.

Health and Safety: Participants are responsible for informing the organizer of any health concerns or special requirements before the event. The organizer is not liable for injuries or health issues arising during the event.

Photography and Media: By attending, you consent to any photography or videography that may be used for promotional purposes unless otherwise stated in writing prior to the event. We highly recommend speaking to the organiser at the event if you do not wish to be apart of this.

Acceptance of Terms: Booking an event placeholder constitutes your acceptance of these terms and conditions.

Private classes (in studio)

If you cancel a private class:

  • At least 24 hours before the class you will get 100% refund, minus any payment processing fees;
  • At least 2 hours before the class you will be charged 50% of the class fee;
  • Less than 2 hours before class you will be charged 100% of the class fee.

Corporate classes (outside studio)

If you cancel a corporate class:

  • At least 48 hours before the class you will get 100% refund, minus any payment processing fees;
  • At least 12 hours before the class you will be charged 50% of the class fee;
  • Less than 12 hours before class you will be charged 100% of the class fee.

Pass policies

Pass extensions (Casual, 5 or 10 class passes)

If you need an extension on your pass we request you purchase a new pass and we can add on any remaining credits from your about-to-expire pass to your new pass.

Limitation of liability

By booking into yoga and/or Pilates classes at Ora Wellness Co., you are acknowledging that you are aware that yoga includes physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If you experience any pain or discomfort, you need to listen to your body, discontinue the activity, and ask for support from the instructor. You assume full responsibility for any and all damages which may occur through participation.

Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. By booking a class, you affirm that a licensed physician has verified your good health and physical condition to participate in such a fitness program, if required. In addition, you will make the instructor aware of any medical conditions or physical limitations before class. If you are pregnant, become pregnant or are post-natal or post-surgical, your agreement to participate verifies that you have your physician’s approval to participate. You also affirm that you alone are responsible to decide whether to practice yoga, and participation is at your own risk. By booking into classes at Ora Wellness Co. you agree to irrevocably release and waive any claims that you have now or may have hereafter against Ora Wellness Co. and all related facilities and premises, from any personal injury or negligence. Additionally, the facility, instructors and Ora Wellness Co. are not in any way responsible for any loss or damage of your personal property.

If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.
